Welcome to the website, www.bookandbottlestpete.com (the “Site”). By using the Site, you represent that you are an adult of 21 or more years of age, have the legal capacity to enter a contract, and agree to comply with and be bound by the following terms and conditions of use. Please review these terms and conditions carefully. If you do not agree to these terms and conditions, you are not authorized to use the Site.

  1. Agreement. This Terms of Use agreement (the "Agreement") governs your access to and use of the Site. This Agreement may be modified at any time by Book + Bottle, LLC (“Book + Bottle”) by posting the modified Agreement to the Site. Any such modifications shall be effective immediately upon posting unless some other effective date is expressly stated. You can view the most recent version of this Agreement at any time at https://www.bookandbottlestpete.com/terms. Your use of this Site shall constitute and be deemed your unconditional acceptance of this Agreement.

  2. Privacy. Your use of the Site is also governed by the Privacy Policy, which is hereby incorporated into this Agreement. Please review the Privacy Policy at https://www.bookandbottlestpete.com/privacy. Book + Bottle reserves the right, and you authorize it, to use and assign all information provided by or collected from you in any manner consistent with the Privacy Policy.

  3. Site Content. The Site is provided on an “as is” basis and may use internet services that are not under Book + Bottle’s direct control. While Book + Bottle strives to provide accurate descriptions of its products, services, and events, it does not warrant that the descriptions, pricing, or other content on the Site are accurate, complete, or current. Book + Bottle does not warrant that the Site or its features will be accessible at all times or that it will function in an error-free manner. Book + Bottle reserves the right to cease operating the Site or any of its features at any time.

  4. Intellectual Property. All content on this Site, including without limitation graphics, logos, trademarks, images, and software, is, and shall continue to be, the property of Book + Bottle or its content suppliers and is protected under applicable copyright, patent, trademark, and other proprietary rights. Any copying, redistribution, use, or publication by you of any such content or any part of the Site is prohibited, except as expressly permitted in this Agreement. Under no circumstances will you acquire any ownership rights or other interest in any content by or through your use of the Site.

  5. Site Use. Book + Bottle grants you a limited, revocable, nonexclusive license to use the Site solely for your own personal use and not for republication, distribution, assignment, sublicense, sale, preparation of derivative works, or other use. You agree not to copy content from the Site, reverse engineer or hack into the Site, or use materials or services in violation of any law. Your use of this Site is at the discretion of Book + Bottle, who may terminate your access and use at any time.

  6. Links to Other Sites. The Site may provide links to other websites. The Site’s Terms of Use or Privacy Policy may not apply to those other websites, which may have their own terms and policies. You should review the terms of use and privacy policies of any other websites that you visit.

  7. The 17 Club. Book + Bottle offers a wine club subscription service (the “17 Club”), which allows subscribers to receive a monthly shipment of selected wines. By signing up for the 17 Club, you agree to the terms and conditions of the subscription service, including the payment of monthly fees, the duration of the subscription, and Book + Bottle’s policies regarding delivery, cancellation, and refunds. You represent and warrant that: (I) you are 21 years of age or older; (II) you will not provide access to the 17 club subscription to any person who is not of legal drinking age; (III) WINE will not be delivered to or consumed by any person who is not of legal drinking age; (iV) WINE is for personal consumption and not for resale; and (V) you are not Subscribing to the 17 Club in violation of any applicable laws or regulations

  8. Online Orders. When you choose to place an order for wine or books through our website, you will be redirected to a third-party platform hosted by Block, Inc. (“Square”) to complete your transaction. By proceeding with an order on that platform, you are making an offer to purchase the selected products for in-store pickup. Please note that while the ordering process is facilitated through Square, the fulfillment of your order remains subject to our acceptance.

We reserve the right to accept or reject any order at our sole discretion, and such acceptance or rejection will apply to the order in its entirety. Even after an order has been confirmed, we reserve the right to cancel it at any time, for any reason, including but not limited to inventory availability or pricing errors. 

By purchasing wine or other related alcohol (“Alcohol”), you represent and warrant that: (i)you are 21 years of age or older; (ii) Alcohol will not be delivered to or consumed by any person who is not of legal drinking age; (iii) Alcohol is for personal consumption and not for resale; and (iii) you are not purchasing Alcohol  in violation of any applicable laws or regulations

  1. Events. Book + Bottle may host various events and activities centered around wine and other alcoholic beverages (“Alcohol-Related Events”), such as wine tastings, pairings, and educational seminars. Details of these events are available on the Website. 

By attending or participating in any Alcohol-Related Event hosted by Book + Bottle, you agree to comply with all applicable laws and regulations, as well as any rules or policies established by Book + Bottle for the event. Book + Bottle reserves the right to refuse admission or remove any individual from any event for any reason, including but not limited to, disruptive behavior, intoxication, or failure to comply with event policies. You represent and warrant that, BY ATTENDING An alcohol-RELATED EVENT, you are 21 years of age or older. 

Book + Bottle may photograph, record, or otherwise document events for promotional purposes. By attending such events, you consent to the Shop's use of your image, voice, and likeness in such documentation for promotional, marketing, or educational purposes without compensation. 

Some events may require advance registration and payment. Refunds are subject to an event’s refund policy. Book + Bottle reserves the right to cancel or reschedule any event at its discretion. In the event of cancellation by Book + Bottle, registered participants will receive a full refund of any registration fees paid

  1. Compliance with Laws. You agree to comply with all applicable laws regarding your use of the Site. You further agree that any and all information provided by you is truthful and accurate to the best of your knowledge.

  2. Indemnification. You agree to indemnify, defend, and hold Book + Bottle and its partners, employees, and affiliates, harmless from any liability, loss, claim, and expense, including reasonable attorney's fees, related to your violation of this Agreement or use of the Site.

  3. Disclaimers. 

    1. THE INFORMATION ON THIS SITE IS PROVIDED ON AN "AS IS," "AS AVAILABLE" BASIS, without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

    2. Book + Bottle Does not guarantee the accuracy, completeness, or timeliness of the information on this Website. The information is provided for general informational purposes only and may not reflect the most current legal developments.

    3. The content on this Website does not constitute legal advice and should not be relied upon as such. Legal advice can only be provided after a formal attorney-client relationship has been established and a thorough understanding of your specific situation has been obtained.

    4. YOU AGREE THAT USE OF THIS SITE IS AT YOUR SOLE RISK. 

  4. Limitation of Liability. UNDER NO CIRCUMSTANCES WILL BOOK + BOTTLE BE LIABLE OR RESPONSIBLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL (INCLUDING DAMAGES FROM LOSS OF BUSINESS, LOST PROFITS, LITIGATION, OR THE LIKE), SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN ANY WAY RELATING TO THE SITE, YOUR SITE USE, OR THE CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE AND/OR CONTENT IS TO CEASE ALL OF YOUR SITE USE.

You may have additional rights under certain laws (including consumer laws) that do not allow the exclusion or limitation of certain damages. If these laws apply to you, the exclusions or limitations in this Agreement that directly conflict with such laws may not apply to you.

  1. Copyrights and Copyright Agent. If you believe your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have otherwise been violated, please provide a notice containing all of the following information to our Copyright Agent:

    1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;

    2. A description of the copyrighted work that you claim has been infringed;

    3. A description of where the material that you claim is infringing is located on the Site;

    4. Your address, telephone number, and e-mail address;

    5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and

    6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

  1. Applicable Law. You agree that the laws of the state of Florida, without regard to conflicts of laws provisions, will govern this Agreement and any dispute that may arise between you and Book + Bottle or its affiliates. Venue shall be the state and federal courts located in Florida.

  2. Severability. If any provision of this Agreement shall be adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect.

  3. Relationship of the Parties. Each party is, and shall remain, an independent contractor, and nothing contained in this Agreement shall be construed to make either party a partner, joint venturer, employee, or agent of the other party, and neither party shall hold itself out as such. Neither party has any right or authority to incur, assume, or create, in writing or otherwise, any warranty, liability, or other obligation of any kind, express or implied, in the name of or on behalf of the other party.
